Accommodation Information

While every reasonable effort is made to ensure that accommodation information is accurate and up to date, minor variations, errors, omissions, or changes may occasionally occur and shall not be considered binding unless expressly stated otherwise.

Each property may also be subject to its own specific rules, limitations, or conditions, as displayed on the relevant listing page. By proceeding with a reservation, the guest also accepts any property-specific rules presented before booking confirmation.

Prices and Charges

All accommodation prices displayed on the website are in euro (€) and include applicable taxes unless otherwise stated.

Any additional charges, including but not limited to cleaning fees, accommodation taxes, service charges, or optional services, are presented during the booking process before confirmation of payment.

The website reserves the right to modify accommodation prices at any time. However, once a reservation has been completed, the price confirmed at the time of booking shall apply to that reservation.

Availability

Accommodation availability shown on the website is indicative and cannot be considered binding until the booking process has been completed and the required payment has been successfully received and accepted.

If a reservation cannot be completed due to technical error, availability conflict, pricing error, or any other justified operational reason, the guest will be informed as soon as reasonably possible and any amount already paid for that reservation will be refunded in full.

Reservation Confirmation

A reservation is considered confirmed only once the required payment, whether deposit or full amount depending on the booking conditions, has been successfully received and accepted.

After the booking process is completed, the guest will receive an electronic confirmation email containing the reservation details. This email serves as confirmation that the reservation request and related payment have been successfully processed.

If the guest does not receive a confirmation email, this does not automatically mean that a reservation has been successfully completed. Guests are encouraged to verify the status of the reservation in case of uncertainty.

Relationship with Property Owners, Payment Collection, and Tax Documents

The website operates as an intermediary platform between guests and independent property owners or duly authorized property managers. The properties listed on the website are owned, operated, and made available by third parties, and the operator of kalymnosescape.com, The Escape Property Management & Vacation Rentals™, acts solely as a booking facilitator and service provider on their behalf.

Each property owner or other legally responsible accommodation provider authorizes the operator to act as its limited commercial agent solely for the purposes of listing, promoting, accepting reservations, collecting accommodation payments in the owner’s name and on the owner’s behalf, and administering reservation-related operations. The operator does not become the accommodation provider, landlord, lessor, or host by reason only of such authorization, unless expressly stated otherwise.

Under the applicable agreement with the property owner, the operator is entitled to retain a commission fee of ten percent (10%) of the total booking value, unless otherwise agreed in writing. Unless expressly stated otherwise during the booking process, that commission is included in the total booking price paid by the guest and does not constitute an additional separate charge to the guest.

All payments made by guests through the website or through payment channels administered by the operator are collected by the operator in the name and on behalf of the property owner or other legally responsible accommodation provider. Following completion of the stay, the operator transfers the corresponding net amount to the property owner within one (1) day after check-out, unless payment is delayed due to pending disputes, complaints, chargebacks, refund requests, damage claims, fraud checks, missing items, rule violations, or other unresolved issues, after deduction of the agreed commission fee and any other lawful or contractually agreed deductions.

The operator may set off against any amount due to the property owner any sums owed by the property owner to the operator under their contractual relationship. The operator may also temporarily withhold part or all of the payout where reasonably necessary for the handling of complaints, disputes, refunds, chargebacks, compensation claims, damages, or other reservation-related issues.

The contractual relationship for the accommodation service is between the guest and the property owner or other person legally responsible for providing the accommodation. Accordingly, the property owner or other legally responsible accommodation provider remains solely responsible for compliance with all applicable legal, tax, regulatory, licensing, registration, invoicing, bookkeeping, consumer, and tourism-related obligations relating to the accommodation and the transaction.

The property owner or other legally responsible accommodation provider is solely responsible for ensuring that the property is safe, properly maintained, suitable for guest accommodation, compliant with all applicable laws and regulations, and appropriately insured.

The property owner or other legally responsible accommodation provider is also responsible for maintaining any insurance coverage required by law or reasonably appropriate for the operation and rental of the property, including property insurance, civil liability insurance, guest-related liability coverage, or any other relevant insurance, where applicable.

The operator is not responsible for the owner’s failure to maintain the property, comply with applicable safety obligations, hold required licenses or registrations, or maintain adequate insurance coverage.

This includes, where required by applicable law, the obligation to issue to the guest the lawful tax document for the accommodation service, including, as applicable, a receipt, invoice, or any other document required by law. The operator issues only its own lawful tax documents for the commission or other services it provides to the property owner, where applicable.

Payment Methods

Depending on the payment option available at the time of booking, payment may be completed either by bank transfer or through Viva.com, using the electronic payment methods supported by that platform at the time of payment.

The website reserves the right to add, remove, or modify available payment methods at any time.

Bank Transfer

Where payment by bank transfer is offered, the transfer must be completed within 2 working days from the date of the reservation request, unless a different deadline is expressly stated during the booking process.

If payment is not received within that period, the reservation request may be automatically cancelled without further obligation.

Bank transfer processing times may vary depending on the financial institution and may require 2 to 3 working days or more. Any bank charges, transfer fees, or intermediary bank costs are borne exclusively by the guest.

The necessary bank account details are provided during the booking process. Guests may also send proof of transfer in order to facilitate payment review and processing. Submission of proof of transfer does not itself constitute confirmation of the reservation.

Electronic Payments through Viva.com

Where electronic payment is offered, payment may be completed securely through the Viva.com electronic payment platform using supported payment methods, including credit cards, debit cards, prepaid cards, and any other payment methods made available by Viva.com at the time of checkout.

The website does not store full debit or credit card details unless expressly stated otherwise by the relevant payment service arrangement. Payment details are entered directly in the secure payment environment of Viva.com or through the secure payment flow supported by that provider.

Transaction Security

Electronic payments are processed through Viva.com using encryption and security protocols such as TLS/SSL, as applicable.

These security measures are intended to protect transaction data during transmission. The website does not gain access to sensitive full card data entered during the payment process, except as may be necessary for limited transaction-related information provided by the payment service for operational purposes.

The guest is responsible for ensuring that all persons included in the reservation or otherwise staying at or entering the property comply with the applicable rules and conditions.

Guests are required to use the accommodation properly and with due care. Guests are responsible for any damage, loss, breakage, excessive dirtiness, misuse, or missing items relating to the property, its furnishings, equipment, keys, and contents, where caused by themselves, their companions, visitors, or any person for whom they are responsible.

Where damage or loss occurs, the guest may be held responsible for the reasonable cost of repair, replacement, restoration, additional cleaning, locksmith services, or any directly related expense.

Guests are also required to report without delay any existing damage, defect, shortage, or malfunction noticed upon arrival or during the stay. Failure to report such issues promptly may result in the guest being held responsible where the circumstances reasonably justify such responsibility.

Guests are responsible for their own safety and conduct during the stay and must use the accommodation, its facilities, equipment, outdoor areas, stairs, balconies, pools, appliances, and any other available amenities with due care and in accordance with the property rules, posted instructions, and normal safety precautions.

Guests are also responsible for the supervision and safety of all persons included in the reservation or otherwise allowed by them to enter or stay at the property, including children, elderly persons, visitors, and persons requiring assistance.

The operator shall not be liable for any injury, accident, loss, damage, or harm suffered by the guest or any accompanying person where such event results from the guest’s own act or omission, negligence, misuse of the property or its facilities, failure to follow instructions or property rules, unauthorized activity, consumption of alcohol or other substances, lack of proper supervision, or any other circumstance attributable to the guest or persons for whom the guest is responsible.

Check-In, Check-Out, and Stay Compliance

Guests must respect the check-in and check-out times applicable to the booked property, unless otherwise agreed in writing.

Guests must ensure that the property is left in a reasonable condition upon departure, taking into account normal use.

Any unauthorized late departure, unauthorized occupancy beyond the agreed number of guests, or use of the property contrary to the listing rules may result in additional charges, refusal of service, termination of stay where legally permitted, or other appropriate action.

No-Show Policy

If the guest does not arrive at the property or otherwise fails to honor the reservation without valid prior cancellation in accordance with the applicable cancellation policy, the reservation will be treated as a no-show.

In such cases, no refund will be due unless otherwise provided by the cancellation policy applicable to the reservation.

Cancellations and Refunds

Reservation cancellation requests may be submitted either through the guest’s account area within the booking platform, where such functionality is available, or through email communication using the contact details made available on the website.

The right to cancel, the applicable deadlines, and any refund entitlement depend on the cancellation policy selected or applicable at the time of booking.

Full details regarding cancellation terms and refund eligibility are set out on the separate Cancellation Policy page and, where applicable, within the booking details presented before reservation confirmation.

In the event of conflict between these terms and the applicable Cancellation Policy for a specific reservation, the Cancellation Policy and the reservation-specific terms shown at the time of booking shall prevail with respect to cancellation and refund matters.

Guest Conduct

Guests must not use the property for any unlawful purpose or in any manner that may cause nuisance, disturbance, danger, or damage to neighbors, third parties, the property, or the surrounding area.

Unless expressly permitted, guests must not organize events, parties, commercial activities, or gatherings at the property.

The operator reserves the right to take appropriate action in case of serious breach of property rules or unlawful conduct, including cancellation or termination of the stay where legally permitted and without prejudice to any further legal rights.

Limitation of Liability

The website and its operator shall not be liable for delays, interruptions, technical failures, booking errors, payment processing issues, unavailability of the website, force majeure events, governmental actions, strikes, natural disasters, transport disruptions, utility failures, third-party acts, or any other circumstances beyond their reasonable control.

To the fullest extent permitted by applicable law, the website and its operator shall not be liable for indirect or consequential loss, loss of enjoyment, loss of profit, loss of opportunity, or any loss not directly resulting from proven fault on their part.

The website and its operator shall not be liable for personal injury, accident, illness, loss, theft, damage, inconvenience, or other harm suffered during the stay where such event arises from the guest’s own conduct, negligence, misuse of the property, failure to comply with property rules or safety instructions, actions of accompanying persons or visitors, acts or omissions of the property owner or accommodation provider, acts of third parties, or circumstances outside the operator’s reasonable control.

Nothing in these terms excludes or limits liability where such exclusion or limitation is not permitted under applicable law.
